Terms & Conditions

These terms govern the use of AGC's website and the basis on which advisory services are discussed and delivered.

1. Acceptance of Terms

By accessing www.anchorglobal.asia or engaging AGC for advisory services, you agree to be bound by these Terms & Conditions.

2. Nature of Services

2.1 Advisory Services Only

AGC provides pre-certification advisory, IT governance, and compliance readiness services only.

  • AGC does: gap analysis, ISO 27001/9001 readiness, ITGC workpapers, regulatory advisory, and Quick Scan diagnostics
  • AGC does not: issue certifications, guarantee certification outcomes, or act as a certification body

All certifications are issued solely by Shanghai NQA Certification (SNQA) or other accredited certification bodies.

2.2 Independence & Conflict Management

AGC maintains separation between readiness advisory and certification issuance to support ISO/IEC 17021 and accreditation expectations.

3. Website Use

3.1 Permitted Use

  • Access and view content for informational purposes
  • Download company profile for evaluation
  • Contact AGC for advisory inquiries
  • Share content with attribution

3.2 Prohibited Activities

  • Reproducing, distributing, or commercialising content without written consent
  • Using automated scraping tools or bots
  • Attempting unauthorised system access
  • Misrepresenting affiliation with AGC, SNQA, BNM, SC, or regulators
  • Using content to compete with AGC or build derivative services

4. Professional Services Engagement

4.1 Separate Engagement Letters

Website terms do not constitute a service agreement. All work requires a signed engagement letter or proposal acceptance, defined scope, fees, and confidentiality terms.

4.2 No Guarantee of Certification Outcomes

AGC does not guarantee certification success, regulatory approval, or audit outcomes without findings.

4.3 Client Responsibilities

  • Provide accurate, complete, and timely information
  • Assign competent personnel for the engagement
  • Implement agreed recommendations
  • Maintain confidentiality of AGC methodologies and workpapers
  • Comply with applicable laws and regulations

4.4 Fees & Payment

  • Quick Scan diagnostics are fixed-fee and payable upfront
  • Advisory engagements follow the engagement letter
  • Late payment charge: 1.5% per month on overdue balances
  • Approved travel and third-party costs billed at cost

4.5 Limitation of Liability

4.6 Indemnification

You agree to indemnify AGC against claims arising from misuse of deliverables, failure to implement recommendations, misrepresentation of AGC advisory as certification, or breach of law.

5. Confidentiality

Both parties agree to protect confidential information with reasonable care, limit disclosure to need-to-know personnel, and comply with PDPA 2010 and applicable data protection laws.

Confidentiality survives for five years post-engagement, or longer where required by law.

6. Regulatory Disclaimers

  • AGC services are not legal advice
  • AGC deliverables are not external audit opinions or certification reports
  • Forward-looking regulatory statements may change over time

7. Third-Party Services

AGC may facilitate introductions to SNQA or coordinate with service providers, subcontractors, or technology vendors. SNQA remains an independent legal entity and AGC has no control over certification decisions.

8. Website Disclaimers

  • Website content is provided on an "as is" basis
  • Accessing the website does not create a professional-client relationship
  • External links are provided for convenience without endorsement

9. Termination

AGC may suspend website access for breach, abuse, fraud, or regulatory requirement. Service engagement termination is governed by the engagement letter.

10. Governing Law & Dispute Resolution

These terms are governed by Malaysian law. Courts of Malaysia have jurisdiction, subject to local law requirements for APAC clients.

  1. Good faith negotiation for 14 days
  2. Mediation if negotiation fails
  3. Optional arbitration in Kuala Lumpur under AIAC rules if both parties agree

11. General Provisions

  • Entire agreement consists of these terms and any engagement letter
  • Material updates require website notice
  • Unenforceable provisions do not affect the remainder
  • Failure to enforce is not a waiver
  • Assignment requires AGC consent except for a successor entity
  • Force majeure applies to events outside AGC's control

12. Special Provisions for APAC Clients

  • Cross-border delivery may be remote or on-site
  • Local regulatory obligations remain the client's responsibility
  • Advisory aligns international standards with local adaptation
  • Malaysia-based delivery may coordinate with local partners in Cambodia and SEA
